Legislative Update – Feb 26, 2019

Bills are going through committee, being voted on and being placed on the Governor’s desk. Some bills have already been signed. Below are a few bills you might be interested in knowing about, reading and thinking about.

SB 1227/HB 2545: Colorado River Drought Contingency amendments – Signed by Governor

SJR 1001/HJR 2002: Colorado River Drought Contingency Plan -Signed by Governor

SB 1143: Arizona Tax Conformity – Vetoed by Governor

SB 1080: A bill identifying TPT funds to be used by education. Includes some changes to the Classroom Site Fund.

SB 1397: An overhaul bill changing several items at the Registrar of Contractors. Changes the way monies collected are distributed, changes some provisions of the RCR (Residential Contractor’s Recovery) Fund. Some persons may no longer need to be licensed by the Department.

HB 2013: Appropriates funds for Arizona Water Protection Fund.

HB 2027: Municipalities are authorized to levy TPT or fees on the gross receipts of an online lodging marketplace.

HB 2037: Provides provisions under which the State Board of Technical Registration may grant certification by endorsement. Includes Home Inspectors, Landscape Architects, Geologists, Engineers, Alarm Companies and Land Surveyors.

HB 2047: Mandates ADOT to distribute $18 million to small counties and municipalities.

HB 2465: Appropriates $10,000,000 to ADOT to study I-10 widening.

HCR 2002: Independent Redistricting Commission ballot measure 2020. Would change the commission to 9 members, prohibit members from being a part of a political campaign within 6 years before appointment, states the method and who appoints members.

HCR 2005: Signatures for Referendums ballot measure 202. Would change the number and type of signatures necessary for measures amending the State Constitution.

SB 1035: Modifies definition of small employer for purposes of small group health plans.

SB 1147: Outlines requirements for city or town to sell or lease municipal owned land or buildings for economic activities.

SB 1460: Digital Goods Tax. Creates parameters for taxable status of online goods. Contains defined exclusions.

SB 1465: Subtractions from Arizona Gross Income for Corporations. Allows corporations to subtract the construction costs for water and wastewater infrastructure from the gross income for tax purposes.

HB 2087: Investor owned short term rentals. Lists the purposes municipalities and counties may regulate short term and vacation rental properties. Includes investor owned and mandates compliance with residential use and zoning codes.

HB 2095: Agricultural Property Classification. Allows agricultural land that become inactive due to a reduction in water supply to maintain its agricultural designation for purposes of property tax.

HB 2201: Requires municipalities to print party affiliation for all candidates running for mayor or city/town council on the ballot.

HB 2360: TPT Estimated Payments. Increases the threshold before estimated TPT payments are required.

HB 2586: Water Supply, Groundwater Credits. Establishes criteria for assured water supply and ground water replenishment within AMA’s.

SB 1475: DNA data base for certain licensed professionals. Now on its third version.
